DEPOSIT AND REFUND

A deposit in the amount agreed upon (half of subtotal) is required at the time of signing this agreement. Deposit is non-refundable 60 days or less prior to the event date. Acceptable forms of payment are: cash, checks, venmo,  major credit cards. The deposit secures the event date and times for the client and is refundable no less than 60 days prior to event date. Clients will pay a $50.00 fee for any and all returned checks.

BALANCE DUE

Balance is non-refundable 30 days or less prior to the event. Photo booth services will not begin until the balance is paid in full. Payment for any overage in time must be paid before additional hours are provided.

PHOTO BOOTH OPERATIONS

Ivy & Grace shall have the photo booth operational for the time period specified; however, in some situations operations may need to be interrupted for maintenance, service and/or photography optimizations. Ivy & Grace agrees to send a qualified attendant to maintain and operate the photo booth for the full duration of the agreed time. Should Ivy & Grace fail to provide a fully operational photo booth during the agreed upon times, the client’s only remedy is a refund of payment received. If only partial services can be provided due to conditions beyond our reasonable control, then the rental charges shall be on a prorated basis. 

 
PHOTO BOOTH SETUP/TEAR DOWN

Ivy & Grace will deliver, set up, and remove the photo booth from the event location. Operation of photo booth times may be adjusted if the event location or client ends the event prior to the contracted end time and no refund of money will apply. The area where the photo booth is to be set up is reasonably accessible and has level ground with electricity. Ivy & Grace requires access to the venue at least 90 minutes before the event and 60 minutes after the event for setup and take down. 

 
SPACE & PLACEMENT REQUIREMENTS

Client agrees to provide: (1) A minimum 20’W x 24’L x 10’H area for our photo booth (2) Easy access to install and remove photo booth via tow vehicle , a 110V, 20 amps, 3 prong standard electrical outlet within 50 feet of our designated area. For open air booth 12 x 12 space is required with electricity in a covered area.  If no electricity is available a generator can be provided for an additional fee of $100. 

 
INCLEMENT WEATHER

Ivy & Grace reserves the right, in good faith, to cease the operation should the weather pose a potential danger to our personnel, the equipment, or guests. Since safety is paramount in all decisions, Ivy & Grace compensation will not be affected if the operation is ended.

LIABILITY AND INDEMNIFICATION

Client agrees to, and understands the following: 1) Client will indemnify provider against any and all liability related to Client’s Event during or after Cient’s Event unless arising from negligence or willful misconduct of Ivy & Grace. 2) Client will indemnify Ivy & Grace against any and all liability associated with the use of pictures taken within Ivy & Grace’s photo booth, it’s representatives, employees or affiliates at the Client’s Event, provided that any use by Ivy & Grace is in accordance with the initiated terms of agreement.  3) Clients will assume all legal fees claimed by third persons, loss of profits or increased expenses, provided that such loss or damage was not caused by the fault or negligence of Ivy & Grace or its employees, agents, or subcontractors. 

 

DAMAGE TO IVY & GRACE EQUIPMENT

Client acknowledges that it shall be responsible for any damage or loss to the  equipment owned by Ivy & Grace caused by: a) any misuse of the equipment by Client or its guests, or b) any theft or disaster (including but not limited to fire, flood or earthquake). c) loss of power or power surges to the photo booths at any time resulting in loss of pictures or damage of software and/or equipment

MODEL RELEASE (We will exclude this release upon request) 
All guests using the photo booth hereby give to Ivy & Grace: The right and permission to copyright and use, photographic portraits or pictures of any photo booth user who may be included intact or in part, made through any and all media now or hereafter known for illustration, art, promotion, advertising, trade, or any other purpose
